1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of The eBook Library (the “Platform,” “Site,” “Service,” “we,” “our,” or “us”).

By accessing, browsing, creating an account, submitting content, purchasing, downloading, or otherwise using The eBook Library, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. Platform Description

The eBook Library is a marketplace, discovery, and referral platform that allows sellers, authors, publishers, creators, and similar users to upload, manage, present, promote, and link to eBooks and related digital content.

The Platform helps users discover eBooks, view seller-created sales pages, submit lead forms, and access seller-provided purchase links or external checkout destinations.

The eBook Library does not act as the direct seller of third-party eBooks listed by independent sellers on the Platform and does not take a percentage of seller sales.

The Platform is designed to remain economical for authors and sellers. The Platform currently charges a fixed fee of $15 per year per eBook listing and may also generate revenue through prime placements, affiliate promotions, or similar platform-level promotional opportunities.

We may also provide tools and features related to:

seller accounts and dashboards
eBook listing management
AI-generated sales page creation
lead capture forms
unsubscribe handling
content moderation
promotional placements
SEO/static pages
marketplace administration

We may change, suspend, remove, or discontinue any feature at any time.

3. Eligibility

By using the Platform, you represent that:

you have legal capacity to enter into a binding agreement
you will comply with these Terms and applicable law
any information you provide is accurate and not misleading
if you create or manage content on behalf of a business or organization, you have authority to do so

4. Accounts

To access certain features, you may need to create an account.

You are responsible for:

maintaining the confidentiality of your login credentials
restricting access to your account
all activity occurring under your account
providing accurate and current information

We reserve the right to suspend, restrict, or terminate accounts that are inaccurate, deceptive, inactive, abusive, unlawful, or otherwise harmful to the Platform or its users.

5. Seller Responsibilities

If you use the Platform as a seller, author, publisher, creator, or content owner, you are solely responsible for:

the legality of the content you upload or publish
the truthfulness and accuracy of claims in your eBook listings and sales pages
your marketing practices and communications
your handling of lead data shared through the Platform
honoring applicable laws and regulations
your tax, licensing, consumer protection, advertising, and disclosure obligations
maintaining rights to any content, text, images, media, or digital materials you submit

You must not publish content that is unlawful, infringing, fraudulent, deceptive, abusive, harmful, defamatory, invasive of privacy, or otherwise objectionable.

6. Content Ownership and License

You retain ownership of content you lawfully own and submit to the Platform. However, by submitting, uploading, publishing, or storing content through The eBook Library, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, distribute, moderate, index, and use that content as necessary to operate, improve, promote, secure, and administer the Platform.

This license includes the right to:

display listings and sales pages publicly
create previews, excerpts, and formatted versions
use content for moderation, search, SEO, and platform functionality
store backups and cached copies
process content through AI or automated formatting tools where enabled by the Platform

You represent that you have all rights necessary to grant this license.

7. AI-Generated Content and Platform Tools

The Platform may provide AI-assisted or automated tools, including tools that help generate or edit sales pages, copy, layouts, or related content.

You acknowledge that:

AI-generated output may contain errors, omissions, or undesirable wording
you are solely responsible for reviewing and approving any generated content before publishing or using it
we do not guarantee that generated content is compliant, accurate, original, merchantable, or fit for any particular purpose
you remain fully responsible for final content placed on your listings or pages

8. Leads, Communications, and Unsubscribes

The Platform may collect lead information from visitors who submit forms on eBook pages.

By using the Platform as a seller, you understand and agree that:

lead data may be shared with the applicable seller and retained by platform administration
unsubscribe requests may remove matching active leads and create unsubscribe records
platform lead and unsubscribe retention periods may be limited under the current system configuration
you are responsible for your own compliance with applicable communication, privacy, and marketing laws after receiving lead data

You must not misuse lead information, send unlawful spam, or ignore applicable unsubscribe requirements.

9. Buyer and Visitor Responsibility

Visitors and buyers are responsible for evaluating whether any eBook, offer, seller, or claim is appropriate for their needs. We do not independently verify every seller claim, marketing statement, earnings claim, performance claim, medical claim, legal claim, financial claim, or factual representation appearing in seller content.

Use judgment before relying on any seller-submitted information.

10. Purchases, Payments, and Transaction Responsibility

The eBook Library is a marketplace, discovery, and referral platform. Sellers may use their own external payment links, checkout systems, or third-party platforms, including but not limited to PayPal, Stripe, Payhip, or similar services.

The eBook Library does not process seller payments and does not take a percentage of seller sales.

Unless explicitly stated otherwise for a specific platform-operated feature:

sellers handle their own payments and transaction terms
sellers are responsible for their own checkout pages, billing terms, delivery terms, and refund terms
refunds, delivery issues, billing disputes, chargebacks, and payment-related issues are generally between the buyer and the seller or the seller’s payment processor
The eBook Library is not the merchant of record for third-party seller transactions
The eBook Library is not responsible for third-party payment processors, external checkout pages, or seller-controlled transaction workflows

Visitors and buyers are responsible for reviewing the seller’s payment terms, refund policies, delivery method, and applicable third-party checkout terms before purchasing.

11. No Professional Advice

Content available through the Platform may include educational, business, marketing, self-help, financial, legal, health, or informational material created by sellers or generated using platform tools.

The eBook Library does not provide legal, medical, tax, accounting, investment, or other professional advice through the Platform, and nothing on the Platform should be treated as such.

Users should consult qualified professionals where appropriate.

12. No Guarantee of Results

We do not guarantee:

sales volume
lead volume
search visibility
conversion rates
earnings or financial outcomes
business success
uninterrupted service
the continued availability of any feature
specific outcomes from using AI tools, sales pages, or listings

Any examples, testimonials, success stories, or claims made by sellers are the responsibility of those sellers and not guarantees by The eBook Library.

13. Affiliate Disclosure and Third-Party Offers

Some pages, content, links, or recommendations on The eBook Library may include affiliate links or promotional links. This means we may earn a commission or other compensation if users click on certain links or make qualifying purchases through those links, at no additional cost to the user unless otherwise stated.

We may also feature, link to, or reference third-party products, services, marketplaces, software tools, or resources.

We do not guarantee the quality, safety, legality, accuracy, or performance of third-party offerings, and users interact with those third parties at their own risk.

14. Prohibited Conduct

You agree not to:

violate any law or regulation
infringe intellectual property or privacy rights
upload malicious code, spam, or harmful material
interfere with the operation or security of the Platform
scrape, copy, or exploit the Platform in an unauthorized way
use bots, scripts, or automation in a harmful or unauthorized manner
impersonate another person or entity
submit false, deceptive, or misleading information
misuse seller, lead, or visitor data
bypass access controls or account restrictions
attempt to reverse engineer or misuse platform tools

15. Moderation and Enforcement Rights

We reserve the right, but not the obligation, to monitor, review, edit, reject, suspend, remove, unpublish, restrict, or investigate any account, eBook, page, listing, lead-related behavior, or content for any reason, including suspected fraud, infringement, spam, abuse, policy violations, security concerns, legal risk, or reputational harm.

We may take action without prior notice where appropriate.

16. Intellectual Property Complaints

If you believe content on the Platform infringes your copyright, trademark, or other rights, contact us at:

Please include enough information for us to identify the content, understand the basis of the complaint, and communicate with you about the issue.

We may remove, disable, or restrict content while reviewing a complaint.

17. Suspension and Termination

We may suspend or terminate access to the Platform, remove content, or restrict functionality at any time, with or without notice, where we believe it is appropriate to protect the Platform, comply with legal obligations, prevent abuse, or enforce these Terms.

Upon suspension or termination:

your access to some or all features may end
your content may be removed, unpublished, or restricted
some records may remain retained for legal, security, accounting, administrative, or compliance purposes

18. Disclaimer of Warranties

The Platform is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, The eBook Library disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, reliability, accuracy, and quiet enjoyment.

We do not warrant that:

the Platform will be uninterrupted, secure, or error-free
content will always be accurate or complete
defects will be corrected
the Platform will meet your expectations or business goals
downloads, files, or transmissions will be free of harmful code

19. Limitation of Liability

To the fullest extent permitted by law, The eBook Library and its owners, operators, affiliates, officers, employees, contractors, licensors, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or other intangible losses arising out of or relating to:

your use of or inability to use the Platform
seller content or third-party content
transactions or interactions with third parties
AI-generated output
data loss
service interruptions
account suspension or content removal
unauthorized access, errors, or security events

If liability is imposed despite the above limitations, our total liability shall be limited to the maximum extent permitted by law and, where applicable, no more than the amount paid by you to The eBook Library in the 12 months preceding the claim.

20. Indemnification

You agree to defend, indemnify, and hold harmless The eBook Library and its owners, operators, affiliates, officers, employees, contractors, licensors, and agents from and against any claims, liabilities, damages, judgments, losses, costs, expenses, and fees, including reasonable attorneys’ fees, arising out of or related to:

your use of the Platform
your content
your violation of these Terms
your violation of law
your infringement or misuse of another party’s rights
your communications, marketing, offers, or transactions as a seller

21. Governing Law

These Terms shall be governed by and construed under the laws of the Commonwealth of Kentucky, without regard to conflict of law principles, except where otherwise required by applicable law.

22. Venue

Any dispute arising out of or relating to these Terms or the Platform shall be brought in the appropriate state or federal courts located in or serving Kentucky, unless applicable law requires otherwise.

23. Severability

If any part of these Terms is found invalid, unenforceable, or unlawful, the remaining provisions will remain in full force and effect to the maximum extent permitted by law.

24. No Waiver

Our failure to enforce any provision of these Terms shall not be considered a waiver of that provision or any other provision.

25. Changes to These Terms

We may revise these Terms from time to time. When we do, we may update the Effective Date and post the revised version on the Platform. Continued use of the Platform after revised Terms are posted constitutes acceptance of the updated Terms to the extent permitted by law.
